Right to search
In some companies there will a requirement to conduct a search of employees. This process would normally form part of the employment contract and by signing the contract employees accept the stop and search requirements within a company.
Companies would look to invoke a stop and search where they believe there is:
- any theft of the Company's property or property belonging to another; and
- the possession or supply of illegal substances.
A right to search would normally cover a stop and search all employees, a search of personal belongings and vehicles on the company's property and carry out a search of all workplace areas, including lockers and any company vehicles.
Where a search is conduct employees would normally be asked to consent to a search and will be required to complete an authorisation form.
Any search on an employee does not indicate that they are under any suspicion of wrongdoing and searches can be carried out at random
